Terms of use
Kailoom is run by gggravity, based in Missouri, United States ("we", "us"). By making an account or using Kailoom you agree to these terms. If you do not agree, please do not use the service. Our privacy policy explains what we do with your data.
Please read the section called "Disputes and arbitration". It means most disputes are settled one by one in arbitration, not in court or in a class action, unless you opt out within 30 days.
Your account
- You must be 16 or older. When you first sign in we ask for your date of birth. Give a true one: we use it to decide what you can use, and giving a false date is a breach of these terms.
- Under 16 can not use Kailoom. People aged 16 and 17 need a parent or guardian's permission, and use it on the Normal content setting only. Adult settings are for people aged 18 and over.
- Accounts of 16 and 17 year olds have extra limits: characters keep everything age-appropriate, friends, messages and group invites only work with other people under 18, and voice clip uploads, photos of real people, Tor and Mullvad routing and buying credits are turned off.
- Give true information and keep your sign-in safe. You are responsible for what happens on your account. One person per account. Do not sell or hand over your account.
What you may not do
- Create, request or share sexual content involving anyone under 18, or characters written or drawn to look under 18. This is never allowed, on any setting, and we block, remove and, where the law requires, report it.
- Make sexual, nude or intimate content of real people, on any setting. This includes celebrities, people you know and characters built from a real person's photos.
- Make characters of private people (friends, exes, classmates, coworkers, anyone who is not a public figure), or use Kailoom to harass, shame or impersonate anyone.
- Pass AI output off as real, including presenting a real person's character, words, picture or voice as genuine, or removing the "AI-generated" label from a picture.
- Upload or copy anyone's voice except your own, or someone who has given you permission. This includes actors and voice actors.
- Upload a photo of a real person and say it is not one. Photos of real people make the character a real-person character. Uploaded photos are never used for adult pictures. Uploaded drawings can guide the adult anime style once an automatic check has confirmed they are drawings.
- Harass, threaten or defraud anyone, or use the service for anything illegal.
- Try to break in, overload the service, scrape it, or get around limits, credits, age groups or content settings.
- Upload things you do not have the right to use, including other people's artwork or voices without permission.
Characters based on real people
You may make characters of public figures, living or historical, for chat, parody and commentary. These characters:
- must be marked as a real person when you make them, and we may mark them for you;
- only work on the Normal content setting, and are always shown as AI and fiction;
- get a voice designed from a description, never a copy of the person's real voice;
- can have reference photos for safe pictures, which are labeled as AI-generated, and can not be used for anything sexual, violent, criminal or political;
- can not be published or sold in the store.
Nothing a real-person character says or does is that person's words, views or endorsement. If you are the person, or act for them, and want a character taken down, see Report content. We remove it.
Fan characters
You may make characters from films, games, books and anime for your own use. Those characters belong to their owners, not to you or to us, and Kailoom is not connected with or endorsed by them. You may share fan characters for free, but you may not sell them in the store. If a rights holder asks us to remove one, we will.
Content
You own what you create. You give us the permission needed to store it and run it through the service for you, and to show it to others only when you share or publish it. When you publish to the store you let other users install and use that copy under the lock settings you choose. You are responsible for your content and promise you have the right to use it.
Pictures, voices, chats and other output are made by AI following your instructions. You decide what to ask for and what to share, and you are responsible for it as if you had made it yourself. We do not review content before it is made, and we are not the author of what you ask the AI to make.
AI output can be wrong, odd or offensive. Do not rely on it for medical, legal or financial decisions. Characters are fiction, not real people, and what they say is not advice.
The sandbox and privacy routing
The AI's sandbox can reach the internet to do tasks for you. Do not use it, or Kailoom's privacy routing, to attack, scan or break into any system, send spam or bulk email, mine cryptocurrency, get around someone else's security, or find, download or share anything illegal. Outgoing mail ports are closed and connections are rate limited. We may keep a record of where a sandbox connected to when we investigate abuse.
Tor and Mullvad routing are optional extras. For Mullvad you must have your own Mullvad subscription and follow Mullvad's terms. Kailoom is not affiliated with or endorsed by Mullvad or the Tor Project, and does not sell VPN service. You are responsible for what you do through these routes.
Copyright, likeness and takedowns
We respect copyright and people's rights over their name, face and voice. How to send a copyright notice, a likeness complaint or a report of intimate images is on our Report content page. Reports of intimate images of a real person are handled within 48 hours. We end the accounts of people who repeatedly infringe or who make content of real people that breaks these terms.
Credits and the store
Credits pay for pictures, voices, music, video and long chats. They have no cash value, are not refundable, cannot be exchanged for money and may be changed or reset if the service changes. Some credits do not work in adult settings; your credits panel in Settings shows how many of yours do. Credit codes work once and stop working on their expiry date. When you buy credits you ask for them to be added straight away, which ends any right to cancel the purchase (in the EU and UK this is the 14-day right of withdrawal for digital content). This does not affect your rights if something you paid for does not work. Supporter perks are provided by Kailoom and can change. When someone buys your listing you receive 80 percent of the price in credits. We can remove listings that break these terms.
Free credits and invite links
Signing in can earn a small weekly credit bonus, and invite links can earn credits once a friend who signed up has used Kailoom on 7 different days. These are meant for real people. Making fake accounts, using several accounts to collect them, or any other farming means the credits can be cancelled and the accounts limited. The amounts and limits can change.
Reviews and reports
You can review a store character only after installing it, and not your own. Keep reviews honest and civil, with no links, sexual wording or content about minors. Anyone can report a store character or a review. Several reports, or a serious one, hide the character from the store until a moderator decides. Reporting in bad faith, or brigading, can lead to limits on your account.
Content settings and identity checks
Everything starts on Normal. Stronger settings are opt-in and for adults only. Turning one on confirms you are an adult and that you are allowed to see such content where you live. Some countries and US states require a verified age for adult content. Adult settings are not available from those places until you pass an identity check, and we use your approximate location (from your connection) to decide this. Do not use a VPN or other tool to get around it. We plan to ask adults to pass an identity check, run by a third-party provider, before they can use the adult settings. When that starts we will update our privacy policy first, and you will only be asked if you want those settings. If a check fails or you decline it, you stay on Normal.
Enforcement and the law
We may warn, limit, suspend or remove accounts and content that break these terms, with or without notice when the harm is serious. Each upheld copyright, likeness or intimate image takedown is a strike on the account that posted it, and an account with three strikes is closed. You can ask us to review a decision at the contact address below.
We report apparent child sexual abuse material to the National Center for Missing and Exploited Children and keep the evidence for as long as the law requires. We answer valid legal requests from law enforcement and may share what we need to protect someone from serious harm.
No guarantees
Kailoom is provided as it is and as available. We try to keep it running but it can go down, change or lose features, and we do not promise that it will be accurate, uninterrupted or fit for a particular purpose. To the extent the law allows, we are not liable for indirect or lost-profit damages, and our total liability for any claim is limited to what you paid us in the 12 months before it, which for most people is nothing. Nothing here limits rights you cannot lose under the law where you live, or liability the law does not let us limit.
If you break the rules
To the extent the law allows, you agree to defend and repay gggravity, and the people who run Kailoom, for any claim, loss, fine or cost (including reasonable legal fees) that comes from your content, your prompts, the characters you make or share, or from you breaking these terms or someone else's rights. That includes claims about copyright, trademarks, privacy, defamation and a person's name, likeness or voice. We may take over the defence of a claim, and you will help us with it.
Ending things
You can delete your account any time in Settings. We can end the service or your access, and if we do we will give notice where we reasonably can. Parts of these terms that are meant to continue, such as the limits on liability, keep applying after your account ends.
Governing law
These terms are governed by the laws of the State of Missouri and the federal laws of the United States, without regard to conflict-of-law rules. The Federal Arbitration Act governs the next section. Anything not sent to arbitration will be brought in the state or federal courts located in Missouri, except where the law where you live gives you the right to bring a claim in your own courts.
Disputes and arbitration
Talk to us first. Before filing any claim, email [email protected] with your name, your account and what you want. We both agree to try to settle it in good faith for 60 days.
Arbitration. If it is not settled, you and we agree that any dispute about Kailoom or these terms is decided by a neutral arbitrator, one person at a time, not by a judge or jury. It is run by the American Arbitration Association under its Consumer Arbitration Rules. You may take part by video or phone, or in the county where you live. For claims under $10,000 we pay the AAA filing and arbitrator fees, unless the arbitrator finds your claim frivolous.
No class actions. Claims may only be brought by you or us individually, not as a plaintiff or member of a class, collective or representative action. The arbitrator can not combine claims from more than one person.
What is left out. Either side may bring a claim in small claims court if it qualifies. Either side may go to court to stop someone infringing copyright, trademarks or other intellectual property, or misusing a person's likeness. Claims the law does not allow to be arbitrated are left out too.
Opting out. You can opt out of this section within 30 days of first agreeing to these terms by emailing [email protected] from your account email, or with your username, saying you opt out of arbitration. It does not change anything else.
If the class action waiver is found unenforceable for a claim, that claim goes to court and not to arbitration. If anyone under 18 uses Kailoom, a parent or guardian is taken to accept these terms for them where the law allows.
Changes and contact
We may update these terms. If a change matters we will tell signed-in users first; continuing to use Kailoom after a change means you accept it. If part of these terms turns out to be unenforceable, the rest still applies. Questions: [email protected]
